Membership Terms of Service

These Membership Terms of Service (this “Agreement”) govern your respective rights and obligations when using one or more of the PetfolkCare membership plans (“PetfolkCare”) offered through Petfolk (“Petfolk”, “we”, “us” and/or “our”). Please note that your use of PetfolkCare and its Membership Benefits (defined below) are also governed by our standard Terms and Conditions (https://petfolk.com/terms-of-service) and Privacy Policy (https://petfolk.com/privacy-policy), as well as all other applicable terms, conditions, limitations, and requirements, all of which are incorporated into and included in this Agreement. If you sign up for PetfolkCare, you expressly agree to accept all these terms, conditions, limitations and requirements.
What is PetfolkCare?
PetfolkCare is a membership that provides pet owners with access to certain veterinary care services (Membership Benefits, as outlined below). PetfolkCare memberships are provided on an annual basis. Customers receive access to Member Benefits after successfully completing payment of Membership Fees, which occur as upfront payments preceding either the initial Annual Membership period or any subsequent annual renewals thereof.

Petfolk reserves the right to add, modify, or remove any limited-time offers as part of the Petfolk Membership Benefits.
Typical Annual PetfolkCare Savings
Typical annual savings of $400 per pet” reflects average savings from actual PetfolkCare member transactions among PetfolkCare members who completed a full year of membership. Savings represent the difference between standard list pricing and the discounted pricing available only to PetfolkCare members. Individual savings depend on each pet’s care needs, service utilization, and clinic pricing. PetfolkCare is not an insurance product or reimbursement plan.
Membership Fees
The standard retail fee for Membership Benefits (“Membership Fees”) for a period of one (1) year (the “Annual Membership”) for both the initial one year period and subsequent annual renewals is $199.00. Note that even if your effective pricing for the first year of membership is below the standard retail fee due to a Promotion or otherwise, your payment due for subsequent membership renewals will be the then-current retail Membership Fee, pending any subsequent Promotions.
Membership Fees are subject to change. We reserve the right to adjust Membership Fees from time to time and will use commercially reasonable efforts to notify you of any change to such fees using customary communication and notice methods. Certain PetfolkCare members may have access to Membership Benefits through their employers, partnerships, professional associations, professional affiliations, or other organizations, and as such, may access Membership Benefits at no cost or with reduced Membership Fees.
Membership Fees are non-refundable. Memberships that are canceled in the middle of a payment period will not be applicable for prorated refunds or billing. Petfolk may, however, provide refunds on a case specific basis at its sole discretion.
Membership Terms
Membership Benefits are provided to dogs and cats only on a “per-pet” basis for the individual dog or cat identified at the time of enrollment in the PetfolkCare membership (the “Pet”). You may enroll one or more additional Pets in a PetfolkCare membership by paying an additional Membership Fee for each such additional Pet to be enrolled. Plan Benefits are only available for the specific Pet enrolled in the PetfolkCare membership and are not transferable. Using or attempting to use Benefits for a pet other than the Pet enrolled in the PetfolkCare membership is a breach of this Agreement and may result in immediate termination of your PetfolkCare membership(s) without refund.
In order to ensure the receipt of Membership Benefits, you must be present with your Pet and identify yourselves as a PetfolkCare membership participant at the time of check-in, purchase, or order. Membership Benefits only apply to purchases and services at participating Petfolk locations and do not apply to any purchases of goods or services through any other unaffiliated third party, including, but not limited to, third party pharmacies and distribution providers. In addition, any ancillary service discounts do not apply under any circumstances to any third-party surgeon and/or vendor services whether or not offered or obtained through Petfolk.
Pricing for goods and services, including application of any Membership Benefits, is calculated at the time of purchase. Prices and availability information are subject to change without notice. Unless otherwise noted, prices do not include taxes or delivery costs, where applicable, which you agree to pay upon ordering and/or purchasing our goods and services.
Membership Cancellation
THIS AGREEMENT AND YOUR PETFOLKCARE MEMBERSHIP AUTOMATICALLY RENEWS UNLESS CANCELED AS PROVIDED HEREIN OR TERMINATED BY PETFOLK.
You may cancel your PetfolkCare membership, thereby stopping automatic renewal of the membership, through either (1) making modifications to your membership in the Petfolk app, or (2) emailing such request to [email protected]. Your cancellation notice must be received by Petfolk at least 30 days prior to your membership renewal date to be effective with respect to the next billing cycle.
If you cancel within 3 business days of your initial enrollment in PetfolkCare, coinciding with successful payment of Membership Fees, we will refund your full Membership Fee; provided that we may withhold from your refund the value of the Membership Benefits (as determined in our sole discretion) used by you, if any, during this 3-business day period. Membership Fees are otherwise non-refundable except as expressly set forth in this Agreement.
You may also cancel your membership in the event of the verified death of your subscribed Pet or if you move to a new area without a Petfolk location within 50 miles of your new location and provide us with appropriate evidence of such relocation, in which case we will refund your Membership Fee on a prorated basis, we may withhold from your refund the value of the Membership Benefits (as determined in our sole discretion) used by you.
PetfolkCare memberships redeemed through a gift card or promotional code are not refundable under any circumstances.
Termination by Us
We may terminate your access to PetfolkCare at our discretion at any time without notice. If we do so, we will give you a prorated refund based on the number of full months remaining in your current membership. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates this Agreement or any applicable law, involves fraud or misuse of PetfolkCare or any of our other services or offerings, or is harmful to our interests or another individual. Our failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of our rights.
Benefit Eligibility
The PetfolkCare Membership provides access to specific discounts and services as listed above. All Membership Benefits are subject to the following limitations, eligibility criteria, and conditions of use:
All services and discounts are available only when deemed clinically appropriate by Petfolk’s veterinary team, in their sole medical discretion. Members may not request services, treatments, or discounts outside of what is medically appropriate for the enrolled pet.
The 'Exams Covered, Up To $99' benefit applies only to the base exam fee per visit. If the exam cost exceeds $99, the member is responsible for the difference. This discount does not apply to any additional appointment-related fees or surcharges, nor does it roll over or transfer if an exam is priced below $99.
The 10% discount on flea, tick, and heartworm preventatives applies only to medications purchased and dispensed in-clinic during an in-person appointment. This benefit does not apply to purchases made through third-party pharmacies, online retailers, or external fulfillment services, even if Petfolk assists in facilitating the order or payment.
The 10% discount on the End of Life Package applies only to the base service fee for qualifying pets. It does not apply to additional cremation services, urns, keepsakes, or other third-party products.
The $200 discount toward spay or neuter is valid for a single spay or neuter procedure per enrolled pet and may only be redeemed once over the lifetime of that pet’s membership if such pet has not already completed a spay or neuter procedure.
The $200 discount toward a dental cleaning may be applied to one qualifying dental cleaning per pet per 12-month membership period. This benefit is available only for cleanings that are recommended by Petfolk’s clinical team and scheduled in accordance with the pet’s individual care plan.
PetfolkCare Limitations
Participation in PetfolkCare and its Membership Benefits are subject to the following limitations:
Petfolk reserves the right to accept or refuse participation in our sole discretion.
We may send you e-mail and other communications related to your participation in PetfolkCare and as a Petfolk customer.
You may not transfer or assign your participation in PetfolkCare or its benefits, except as expressly allowed by this Agreement.
From time to time, we may choose in our sole discretion to add or remove certain PetfolkCare benefits.
PetfolkCare is not eligible for litter, breeders or 501(c) rescue groups, unless consent is received in writing from Petfolk.
Petfolk reserves the right to modify, suspend or discontinue the PetfolkCare program or any product or service to which it connects, with or without notice, and we shall not be liable to you or to any third party for any such modification, suspension or discontinuance. Petfolk may at its sole discretion from time to time develop updates and other modifications to improve the program or related products or services.
Payment Details and Automatic Renewal
A minimum commitment of one (1) year of enrollment is required for all PetfolkCare memberships. From time to time, we may offer different or other promotional membership terms and/or fees on a limited time basis. Membership Fees are non-refundable except as expressly set forth in this Agreement. By enrolling in the PetfolkCare membership, you agree to pay for all services and other items you purchase and/or order from us through the PetfolkCare membership, whether or not these services and other items are included as part of Member Benefits or purchased separately.
ANNUAL MEMBERSHIP IS BILLED YEARLY UPFRONT. YOU AUTHORIZE US TO CHARGE THE CREDIT CARD ON FILE FOR ALL MEMBERSHIP FEES OR OTHER FEES ASSOCIATED WITH THE PETFOLKCARE MEMBERSHIP AND ALL AUTOMATIC RENEWALS, OR, IF WE ARE UNABLE TO COMPLETE PAYMENT USING SUCH CARD, TO ANY OTHER CREDIT CARD WE MAY HAVE ON FILE ASSOCIATED WITH YOUR ACCOUNT.
If your credit card, payment, or billing information changes, you agree to promptly notify us to ensure that there is not a lapse in enrollment or loss of Membership Benefits. If all eligible payment methods we have on file for you are declined for payment of your Membership Fees, you must provide us a new eligible payment method promptly or your membership will be canceled and you will still be liable for any remaining fees. If you provide us with a new eligible payment method and are successfully charged, your new membership period will be based on the original renewal date and not the date of the successful charge.
If we are unable to ultimately collect payment of your plan fee or any portion thereof, your membership will be canceled and you will be retroactively liable for and agree to pay in full the full retail value of all services and other items you purchased and/or ordered from us.
Late payment fees of the lesser of (a) 1.5% per month or (b) the maximum amount permitted by applicable law may be assessed for all amounts past due for more than thirty (30) days. Should we have to hire an attorney or collection agency to secure payment of any amount due, you will be responsible for paying all reasonable attorneys’ fees and costs associated with collection of such past due amounts.
UNLESS YOU NOTIFY US THAT YOU DO NOT WANT TO AUTO RENEW PRIOR TO THE EXPIRATION OF THE TERM OR RENEWAL TERM AS APPLICABLE, YOU UNDERSTAND YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW AND CONTINUE FOR ADDITIONAL ONE (1) YEAR TERM (EACH A “RENEWAL TERM”) AT THE THEN EFFECTIVE PRICING FOR MEMBERSHIP FEES, AND YOU AUTHORIZE US (WITHOUT ADDITIONAL NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEES AND ANY TAXES USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.
If at the time of renewal your current membership is no longer available and/or if your Pet is no longer eligible for your current membership, you understand and agree that you and your Pet will be automatically enrolled in another similar plan as determined in the sole discretion of Petfolk.
Plan Version and Transition
Membership Benefits reflect the then-current PetfolkCare offering at the time of your enrollment or annual renewal. From time to time, Petfolk may revise the scope or structure of the Membership Benefits for new enrollments and renewals. Members who enrolled under a prior version of the PetfolkCare plan will retain their existing Membership Benefits through the end of their current annual term, after which their membership will automatically renew to the then-current PetfolkCare plan and associated benefits. The scope of benefits in any future version may differ from that of your current version.
Representative Annual Savings (Marketing Disclosures)
Savings figures referenced in marketing materials are illustrative and based on typical usage across representative locations. Actual savings will vary by pet and by clinic. Prices for goods and services may vary by Petfolk location and are subject to change without notice.
Representative savings do not include the cost of the annual PetfolkCare membership fee.
Certain PetfolkCare marketing materials may reference typical savings levels that a PetfolkCare member may realize over the course of a given year or a pet’s lifetime. For example, “typical savings of $600 or more” is a representative figure based on an example pet receiving the following services during a 12-month period: wellness services, including one veterinarian exam, one wellness bloodwork panel, one heartworm test, one fecal test, one dental cleaning, and four core vaccines as part of routine care; plus illness services, including two veterinarian exams, one illness bloodwork panel, and one X-ray as part of illness or urgent care treatment. If a member were to receive all of these services in a given year, the total value of PetfolkCare savings would be approximately $600, based on current retail pricing and applicable discounts at representative Petfolk locations.
From time to time, Petfolk may present additional illustrative savings examples that are calculated using similar methodology. These examples are likewise intended for illustrative purposes only and are not guaranteed.
No Medical or Veterinary Advice; Not Insurance
No veterinarian-client-patient relationship is created by enrolling in, using, or interacting with PetfolkCare. The provision of the PetfolkCare program should not be construed as the practice of medicine or veterinary medicine by us or professional veterinary or medical advice, diagnosis or treatment of any kind. Petfolk shall not be responsible for any advice or information obtained through or due to your use of PetfolkCare.
Please consult your veterinarian or other qualified health provider if you have any questions about a pet’s medical condition or before providing any drug to a pet, changing a pet’s diet, or starting or stopping any course of treatment for a pet. You should not disregard medical advice or delay seeking medical advice as a result of any information that does not come directly from your veterinary professional, and it is your responsibility to review and confirm any such information with your medical or veterinary professional prior to relying on it.
Further, the PetfolkCare program is not insurance and is not intended as a substitute for insurance, and there is no guarantee that any portion of either PetfolkCare or goods and services provided by Petfolk will be covered by any form of insurance.
Virtual Care Informed Consent
Virtual Care involves the use of electronic communications to enable animal health care providers at distant locations to access individual patient medical information and provide healthcare services for the purpose of improving animal care. Providers may include primary care veterinarians, specialists, and/or subspecialists. The information may be used for diagnosis, therapy, follow-up, and/or education, and may include any of the following:
Patient Medical records
Medical images
Real-time text communication
Asynchronous text communication
Live two-way audio and video
Output data from medical devices and sound and video files
Electronic systems used will incorporate network and software security protocols to protect the confidentiality of client and patient identification and imaging data and will include measures to safeguard the data and ensure its integrity against intentional or unintentional corruption. Veterinary practice laws and regulations differ from state to state and all Petfolk virtual care services are in compliance with applicable veterinary practice laws and regulations in the state in which your pet resides or is receiving care.
The following anticipated benefits can be obtained through virtual care: Improved access to medical care by enabling a customer and pet to remain at a remote site while the provider at a distant site obtains history, vitals, and other details of the patient’s current status, test results, and/or consults from other providers at distant/other sites
More efficient medical evaluation and management
Obtaining expertise of a distant specialist in some circumstances
Virtual care is inherently different from in-person care. Thus, while unlikely, this care offering can result in deficits including but not limited to:
- In rare cases, information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate medical decision-making by the provider(s)
Delays in medical evaluation and treatment could occur due to deficiencies or failures of the equipment
In very rare instances, security protocols could fail, causing a breach of privacy of personal medical information
In rare cases, a lack of access to complete medical records may result in adverse drug interactions or allergic reactions, or other judgment errors
Therefore you understand and agree to the following:
You understand that the laws that protect the privacy and the confidentiality of medical information also apply to virtual care and that no information obtained in the use of virtual care which identifies you or your pet will be disclosed to a third party without your consent.
You understand that you have the right to withhold or withdraw consent to the use of virtual care in the course of your pet’s care and can opt for in-person care at any time, without affecting the pet’s right to future care or treatment.
You understand that you have the right to inspect all information obtained and recorded in the course of a virtual care interaction and may receive copies of this information.
You understand that your pet’s virtual care appointments may be recorded by Petfolk for quality and medical record purposes.
You understand the virtual care appointment(s) will occur at the time(s) agreed upon by you and the provider. A “No-Show” or missed appointment, without proper 24-hour notification, may result in a fee. Repeatedly missed appointments may result in the inability to schedule future appointments. We understand that situations such as medical emergencies occasionally arise. These situations will be considered on a case-by-case basis.
You understand that a variety of alternative methods of medical care may be available to your pet and that you may choose one or more of these at any time. A Petfolk representative is available to explain the alternatives.
The use of virtual care services is subject to the discretion of a Petfolk provider, is temporary in nature, and is based upon the assessment of the pet’s clinical needs which may not be fully realized until the virtual care appointment is in progress.
You understand that it is your duty to inform your pet's primary care veterinarian of electronic interactions regarding the pet’s care if their primary care provider is not Petfolk.
You understand that you may expect the anticipated benefits for the patient from the use of virtual care in their care, but that no results can be guaranteed or assured.
You acknowledge and agree that you have read and understand the information provided above regarding virtual care. If you require it, you have discussed it with a Petfolk representative and all of your questions have been answered to your satisfaction, and you hereby give your informed consent for the use of virtual care in your pet’s medical care at the discretion of the Petfolk provider.
Promotions or Free Trials
Petfolk reserves the right to introduce special promotions, trials, temporary membership, or other programs (“Promotions”). These Promotions may provide full or partial membership access to Membership Benefits, and may be made available only within the specified time period (“Promotion Period”). Promotions are only for personal use and may not be shared or resold. Existing PetfolkCare members will be billed in accordance with their current membership rates and will renew at the then-prevailing rates for membership. Further, existing PetfolkCare are not entitled to receive the benefit, either on a retroactive or go-forward renewal basis, of any superior Promotion being run at any time. You may be required to provide your credit card when registering for Promotion or otherwise during the Promotion. Membership Fees shall be waived or discounted during Promotion periods in accordance with the associated offer. Promotions do not apply to additional services outside of the scope of Membership Benefits. You understand and agree that services sought during the Promotion that extend beyond the scope of Membership Benefits (including without limitation, treatments, diagnostics, and medications) will remain your responsibility to pay during the Promotion period.
For Promotions that automatically convert to paid membership at the end of the Promotion, if you do not wish to continue as a paid member, you must cancel your Promotion membership before the end of the Promotion period in order to avoid being charged the annual Membership Fee.
Miscellaneous Terms
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws rules.
No waiver by Petfolk of any of the provisions set forth in this Agreement shall be deemed a further or continuing waiver of such provision or a waiver of any other provision, term, or condition, and any failure of Petfolk to assert a right or provision under this Agreement shall not constitute a waiver of such right or provision.
Our failure to act on or enforce any provision of this Agreement shall not be construed as a waiver of that provision or any other provision. No waiver shall be effective against us unless made in writing, and no such waiver shall be construed as a waiver in any other or subsequent instance. The section headings are provided merely for convenience and shall not be given any legal import. The Agreement will inure to the benefit of each party’s successors, assigns, licensees, and sublicensees.
If any provision of this Agreement is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of this Agreement will continue in full force and effect.
We may in our discretion change this Agreement, the Petfolk Terms and Conditions and/or our Privacy Policy (both linked above), or any aspect of PetfolkCare, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.
YOUR CONTINUED ENROLLMENT IN A PETFOLKCARE MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.
This Agreement, and the Terms and Conditions and our Privacy Policy (both linked above), constitute the sole and entire agreement between you and us with respect to PetfolkCare and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to PetfolkCare.
